Terms and Conditions
Effective date: 1 September 2026
Last updated: 10 September 2026
Apex Alpha Solutions Limited ("the Company", "we", "us") develops and operates the Safety Cycle mobile application and its associated management system ("the System"). These Terms and Conditions ("these Terms") form the agreement between you and the Company governing your use of the System.
1. Acceptance of Terms
By logging in to or otherwise using the System, you confirm that you have read, understood and agree to be bound by these Terms and by the Company's Privacy Policy. If you do not agree, please stop using the System.
2. Definitions
• "User" means a person authorised to log in to the System, including site supervisors (foremen) and administrators.
• "Worker" means a site worker whose personal data is entered into the System by a User on their behalf.
• "Safety Form" means a daily safety cycle form and its related records produced through the System.
3. Scope of Service
The System is designed for construction site safety management and provides:
• Preparation, submission and review of daily safety cycle forms
• Recording and checking of workers' safety qualifications and certificate validity
• Reminders when certificates are approaching expiry
• Generation of safety form documents for filing and submission
The System is a recording and management tool only. It does not constitute a safety assessment, nor legal or professional advice. Statutory responsibility for site safety remains with the relevant contractors, employers and responsible persons.
4. Accounts
4.1 Accounts are created by the Company or by an administrator of your organisation. Public self-registration is not available.
4.2 You must keep your login name, password and two-factor authentication device secure, and must not transfer or share them.
4.3 All activity carried out under your account is deemed to be carried out by you. You must notify the Company immediately if you become aware of any unauthorised access.
4.4 The Company may require you to change your password or re-enrol two-factor authentication where necessary for security.
5. Your Responsibilities Regarding Workers' Personal Data
This is an important clause. Please read it carefully.
5.1 Workers' names, phone numbers, certificate photographs and signatures are entered into the System by Users on the workers' behalf.
5.2 Before entering such data, the User must ensure that the purpose of collection has been clearly explained to the worker, that the worker's consent has been obtained, and that the data entered is accurate, relevant and not excessive.
5.3 Users must not enter personal data that is unrelated to site safety management.
5.4 In respect of the lawfulness of such collection and the obtaining of workers' consent, the User is the data user under the Hong Kong Personal Data (Privacy) Ordinance and bears the corresponding responsibility. The Company provides storage and processing services on the User's instructions only.
6. Accuracy of Records
Safety Forms are records of site safety management and may be used for statutory audit, insurance claims or dispute resolution. Users must ensure that the information entered is true, complete and accurate. The Company does not verify the truth of form content and is not responsible for consequences arising from inaccurate content.
7. Acceptable Use
When using the System, you must not:
• Upload false information, impersonate another person, or enter data unrelated to the relevant site project
• Attempt to bypass authentication or access data outside your authorisation
• Use automated programs to scrape, scan or interfere with the System at scale
• Reverse engineer, decompile or make unauthorised modifications to the System
• Use the System in any way that breaches Hong Kong law or infringes the rights of others
Breach of any of the above may result in immediate suspension or termination of the account concerned.
8. Intellectual Property
All intellectual property rights in the System's software, interface design, form templates, document templates and related documentation belong to the Company or its licensors. You are granted a limited, non-transferable, non-sublicensable right to use the System within the scope of your authorisation.
Business data and Safety Form content that you enter through the System remain the property of you or your organisation. You grant the Company the rights to process, store and back up such data as necessary to provide the service.
9. Service Availability
The Company will use reasonable efforts to keep the System operational but does not warrant uninterrupted or error-free service. The Company may suspend the service for maintenance, upgrades or events beyond its reasonable control. Where maintenance is planned, advance notice will be given so far as practicable.
10. Limitation of Liability
10.1 To the maximum extent permitted by Hong Kong law, the System is provided "as is" and the Company makes no express or implied warranty of fitness for any particular purpose.
10.2 The Company is not liable for indirect loss, loss of profit, business interruption or data loss arising from use of, or inability to use, the System.
10.3 In any event, the Company's aggregate liability under these Terms is limited to the service fees actually paid by you (or your organisation) for the System in the twelve months preceding the event giving rise to the claim.
10.4 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.
11. Indemnity
You will indemnify the Company against losses, liabilities and reasonable legal costs it incurs as a result of your breach of these Terms, your breach of applicable law, or any third-party claim (including by a Worker) arising from data you have entered.
12. Data Backup
The Company performs regular backups of System data. Users should nonetheless retain their own copies of Safety Forms they consider important. The Company's liability for data loss does not exceed the cap set out in clause 10.
13. Termination
13.1 You may request deactivation of your account at any time.
13.2 The Company may suspend or terminate your account for serious or persistent breach of these Terms.
13.3 Following termination, data is handled in accordance with the retention periods set out in clause 6 of the Privacy Policy.
14. Changes to These Terms
The Company may revise these Terms from time to time. Revised versions will be published on this page with an updated "Last updated" date. Continued use of the System after a revision takes effect constitutes acceptance of the revision.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. The parties submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region in respect of any dispute arising out of or in connection with these Terms.
